Maxxit Terms of Use

By creating an account or using Maxxit ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

1. Medical Disclaimer

Maxxit is a fitness tracking tool and does not constitute medical advice. Consult a qualified healthcare professional before beginning any exercise program.

The App's readiness scores, coaching insights, and AI assistant provide general fitness information only. They are not medical diagnoses, treatment, or advice. Never disregard professional medical advice or delay seeking it because of something shown in the App. If you experience pain, dizziness, shortness of breath, or any concerning symptom while exercising, stop immediately and seek medical attention.

2. Your Account

• You must provide accurate information and keep your credentials secure.
• You are responsible for all activity under your account.
• You must be at least 13 years old to use the App.
• We may suspend or terminate accounts that violate these terms.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to manipulate the leaderboard or XP system through fraudulent activity.
• Reverse engineer, decompile, or tamper with the App or its services.
• Upload content that is offensive, infringing, or harmful.
• Interfere with other users' enjoyment of the App.

4. Purchases & Subscriptions

• In-app purchases and subscriptions are processed by Apple through your Apple Account.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple Account settings.
• All sales are final and no refunds are provided by Maxxit, except where required by law or granted by Apple under Apple's refund policies. Refund requests are handled exclusively by Apple at reportaproblem.apple.com.
• Prices may change; renewals after a price change require your consent per App Store rules.

5. Intellectual Property

The App, including its design, code, content, and branding, is owned by Maxxit and protected by intellectual-property laws. You retain ownership of the workout data you create. You grant us a limited license to store and process that data to operate the service.

6. Leaderboard & Community Features

Your display name, level, and XP total are visible to other users on the leaderboard. Choose a display name appropriate for a public audience.

7. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate access for violation of these terms, with notice where practicable. Sections 1, 5, 8, and 9 survive termination.

8. Disclaimers & Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAXXIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY INJURY ARISING FROM YOUR EXERCISE ACTIVITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in California.

10. Changes to These Terms

We may update these terms; material changes will be announced in the App. Continued use after changes constitutes acceptance.
